§ 28-9. Stagnant water nuisance prohibited.

  • It shall be the duty of the owner, or any person in actual or constructive possession or control of or in charge of any real property located within the limits of the town to prevent the concentration or accumulation of stagnant water on any real property situated within the limits of the town. This section shall include, but not be limited to, poor surface drainage, non-engineered ponds (whether man made or natural), swimming pools, wading pools, ornamental ponds, buckets, non-mounted tires, boats, vessels or receptacles, etc., which could provide habitat or breeding areas for insects or attract insects, vermin or pests. This section is not intended to restrict the use of pools, spas, ornamental ponds, etc., provided that they are equipped with the proper operable circulation and filtration systems or children's wading pools that are being properly maintained and are not creating a nuisance.
