§ 44-35. Advance notice of proposed sewer work.

  • (a)

    Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    Person means any natural person, firm, corporation or other legal entity.

    Sewer work means any work or activity undertaken to repair, replace, open, unstop, bypass, clean out or otherwise relating to any sewer line or sewer system on or serving any private property or any public property owned by any public entity other than the town.

    (b)

    Terms and requirements. The terms and requirements of this section shall be applicable to and shall govern the actions of all persons undertaking any sewer work within the municipal limits or the police jurisdiction of the town.

    (c)

    Notice requirement. Any person who proposes to do any sewer work in the town or its police jurisdiction shall, before beginning such sewer work, give notice to the town of such intention, said notice to be given when the person actually performing the work is dispatched for such purpose or before such person departs to undertake such work in the case of service calls taken by the person actually performing the work, by telephoning the town hall at 256-784-5922 and so notifying the town of such intentions. If such a call is not handled in person by a representative of the town and either an answering service or an automated system handles the call for the town, notice shall be deemed given if a message is communicated to such service or system. The notice or message shall include the nature of the proposed sewer work, the address where the work is to be performed, the approximate time of commencement of such work and, if known, the name of the property owner involved.

    (d)

    Cooperation. Any person undertaking to do sewer work in the town or the police jurisdiction thereof, shall cooperate to the fullest practicable extent with the town utilities department in fulfilling the objectives of this section.
